1). we went to
2). For Knee operation
Madhaviben Thakkar got admitted on 12.04.2021 and we understood expense details.
Estimated cost for complete treatment will be given by hospital was rs.
2,78,000.
3). considering Doctor as a
God we got admitted. Operation was performed on same day of admission. We have
paid the amount as decided. We were given leave on 15.04.2021 with
understanding of dressing without any explanation.
4). we have paid the bill
as discussed and got updated that operation was done well and my mother would
be able to walk again without any pain. We came back home after to this. So
much of blood and puss was coming out from the area where knee operation was
performed from the day we came back home. Bed sheet was so dirty and we came to
know that operation was not done properly. Situation was getting worsen day by
day. Due to this we contacted
5). Upon re-admission
doctors have continued treatment. During treatment, they immediately demanded
rs. We have paid complete amount via HDFC ERGO as discussed earlier for Knee
Replacement. But, with intention that my mother gets excellent treatment
without pain once again we have paid additional amount of rs. 2,23,000 on
18.04.2021 via same insurance company.
6). During our mother’s
treatment, instead of correcting the mistake; during operation, doctors did new
experiments. At that time, biopsy was taken from knee for report. Report done
by shalby was not done properly and with the intention of not revealing the
negligence of doctor for the hospital to harassed patient and to snatch more
amount of money.
7). we were tortured a lot
mentally, physically and financially by demanding more money.
8). Due to unbearable
torture given by shalby hospital to my mother and us; we have lodged a
complaint at Anandnagar police station on 10.05.2021. Also, I set on fasting as
per Gandhiji’s rule and have updated people with the help of social media by
creating video for Public Awareness and justice.
9). Due to social media,
many people came from society including electronic and print media as well
political parties for help in getting justice.
10). As there is an alleged
and serious mistake done by shalby hospital and doctors; they tried to kill my
mother. My mother’s health was constantly getting deteriorated so, I have asked
to get justice from police. Doctors also demanded more money from our end and
they stopped all services and facilities. Despite her critical condition, we
were repeatedly told us to leave the hospital. Many times I called on control
number (100); Anandnagar PI, Zone 7 DCP Saheb as well as Satellite PI in
charge, SP Saheb and SP Madam Saheb were known to this matter. No concrete
action was taken in the matter of justice.
11). Doctors of shalby
hospital are associated with political leaders, governments and semi-government
officials so, no complaint has been lodged against medical negligence and for
the death of my mother. Competent authority hides this and because of their
relationship no action has been taken by them.
12). At the time of
complaint we have submitted treatment papers of Shalby hospital at Anandnagar
police station.

of Shalby with civil hospital; Doctors have said that there is no medical
negligence and because of that your complaint won’t be considered. They took
the stand of Hon’ble Judge of Supreme Court, Shri Lalita Kumari and stated that
complaint of healthcare can be filed after taking an opinion from govt.
hospital only. And, in your case medical negligence is not proved. So, your

serious defects, and they interchanged biopsy blocks. They have shared
photocopy of the same as evidence.
16). Due to unbearable torture and pressure she was discharged
on 18.05.2021 from shalby hospital as per their record but in actual the date
is 23.05.2021 and she was shifted to indovasc hospital. Evidence of same is
available in the CCTV cameras of
17). we as an applicant took our mother madhavi ben to shalby hospital
by walking on her on foot. But, on the name of treatment only money has been

We have spent
money more than our level, capability and strength to save my mother whom we
took hospital on her own foot for betterment of life, but doctors of shalby
hospital including management have done serious, fraudulent and worst act of
negligence and inhuman act. Doctors of shalby hospital and management pushed my
mother’s life to the brink of death. None of the complaint has been taken up to
the interest of justice till date.
We have
complained almost all competent authority via writing over an email but till
date no action has been taken against shalby hospital and doctors. According to
the constitution of
It’s clearly visible
that police and authorities wasting time by not understanding human values and
not doing proper mean of investigation. Despite all evidence presented by us in
English IPS level officers who pretend to be knowledgeable and expert they are
performing the action against human life and medical negligence. We have
already shared reports of shalby hospital and other places where clearly
discrepancies were visible. Ideally police and civil hospital’s doctors have to
review case from the inception covering all sides but they have share the
status with one sided reviewance of case. Anyhow they are trying to hide
medical negligence and saving shalby hospital and team of doctors like Vikram
Shah.
It’s our humble
request being applicant that consider all reports with seriousness by
understanding the value of human and humanity as a factual part. Bring justice
on the table considering competent authorities, govt and semi government sector
for this incident as a part of resultant honesty and valuable support for my
mother as well for other families.
Seeking support
to take justice out by taking legal action on such doctors, shalby management
and staff upon the evidence presented. I pray you to advise higher authority
and competent parties to lodge a complaint by taking legal action against
management of shalby hospital and Doc. Vikram Shah.

બંસરી બેન ઠકકર જે પોતાની માતૃશ્રી ની ગોઠણ નીરિપ્લેસ કરવા શેલ્બી હોસ્પિટલ અમદાવાદ કરાવી ૬.૫૦ લાખ રૂપિયા ચુકવણી કરેલ પરંતુ અત્યંત ભૂલ ભરેલી સારવાર ને લીધે ગોઠણ માંથી અતિશય અવિરત રીતે બ્લડિંગ થતા હોસ્પિટલ શેલ્બી માં પરત લાવતા ફરીથી ૯ લાખ હોસ્પિટલ મેનેજમેન્ટ દ્વારા માંગવા માં આવેલ વિકૃત માનસિકતા ધરાવતા હોસ્પિટલ નાં લોકો ગંભીર ભૂલ ભરેલી સારવાર કરેલી જે નઈ સ્વીકાર કરતા વધુ પૈસા ની માંગણી કરવામાં આવી રહી છે બંસરી બેન પોતાના માતા ને થયેલ અન્યાય સામે ન્યાય માટે દેશ ના વડા પ્રધાનશ્રી. રાજ્ય ના મુખ્ય મંત્રીશ્રી. આરોગ્ય મંત્રીશ્રી. આરોગ્ય સચિવશ્રી ગૃહમંત્રીશ્રી. ગૃહસચિવશ્રી. ડીજીશ્રી. પોલીસકમિશ્નર શ્રી. સ્થાનિક પોલીસ પ્રશાસન લોહાણા ઠકકર સમાજ ના તેમજ અન્ય સમાજ ના લોકો પાસે ન્યાય અપાવા મદદ માટે બંસરી બેન ઠકકર અપીલ કરે છે જ્યાં સુધી ન્યાય નહિ મળે ત્યાં સુધી આમરણ ઉપવાસ પર શેલ્બી હોસ્પિટલ બહાર બેઠા છે. આ બાબતે આમ આદમી પાર્ટીના સવ્યંભુ મદદે આવેલા પણ હજી સુધી કોઇ ન્યાય મળેલ નથી ઉપરથી ધમકી આપવા મા આવે છે કે ડીસચાર્જ લઈ લો લખી ને આપો કે પૈસા નથી ઉલટા ચોર કોટવાલ કો ડાટે જેવી નિર્લજ વાતો હોસ્પિટલ મેનેજમેન્ટ દ્વારા કરવા માં આવી રહી છે બંસરી બેન ઠકકર અપીલ કરે છે કે પ્લીઝ પ્લીઝ પ્લીઝ ન્યાય આપવો. હવે જોવાનુ એ છે કે ન્યાય મળશે કે પછી શેલ્બી હોસ્પિટલ મેનેજમેન્ટ ની ઘોર બેદરકારી ને છાવરી ભીનું સંકેલવા માં આવશે ??????
હોસ્પિટલમાં મારામારીના દ્રશ્યો
અમદાવાદની જાણીતી હોસ્પિટલોમાં શેલ્બી હોસ્પિટલનું નામ આવે છે પરંતુ સારવાર માટે લાખો રૂપિયા લેતી ખાનગી હોસ્પિટલે ઊભી કરેલી છબી પરથી હવે પડદો ઉઠી રહ્યો તેવું દેખાઈ રહ્યું છે. અમદાવાદના વૃદ્ધાના ખોટા પગનું ઓપરેશન કરી દેવાના કેસમાં હોસ્પિટલે આજે પણ દાદાગીરી કરી હતી. વૃદ્ધા દર્દીને ડિસ્ચાર્જ કરવા સમયે પણ શેલ્બી હોસ્પિટલમાં ભારે હોબાળો તથા મારપીટના દ્રશ્યો જોવા મળ્યા હતા. બાઉન્સરોએ પોલીસની હાજરીમાં જ દાદાગીરી કરી.
દર્દી સાથે પણ કરવામાં આવી ગેરવર્તણૂક
દર્દીના સ્વજનો તથા દર્દીના દીકરી બંસી ઠક્કર માતાને મેન ગેટથી લઈ જવા માંગતા હતા પરંતુ તેમાં પણ હોસ્પિટલે દાદાગીરી શરૂ કરી તથા બાઉન્સરો ગોઠવી દીધા. સ્વજનોએ પોલીસ બોલાવી છતાં પોલીસની હાજરીમાં જ હોસ્પિટલના બાઉન્સરોએ લૂખાઓની માફક લોકો સાથે ધક્કામુક્કી કરી હતી. કરોડ રૂપિયાનો બિઝનેસ કરતી હોસ્પિટલે ડિસ્ચાર્જ સમયે દર્દીને સ્ટ્રેચર પણ ન આપ્યું. જોકે બબાલ બાદ તેમને મેન ગેટથી જ અન્ય હોસ્પિટલ ખસેડવામાં આવ્યા છે.
પોલીસની હાજરીમાં પણ હોસ્પિટલ દ્વારા કરવામાં આવતી આ દાદાગીરી બાદ સવાલ ઊભા થાય છે કે હોસ્પિટલના તંત્ર પર કોના ચાર હાથ છે કે પોલીસની નજર સામે જ હોસ્પિટલ દ્વારા આવી દાદાગીરી કરવામાં આવી છે. અને શું અમદાવાદના તંત્રને હોસ્પિટલની આ દાદાગીરી નથી દેખાતી?
શું છે આખો મામલો?
અમદાવાદની સેલ્બી હોસ્પિટલમાં 12મી એપ્રિલે માધવીબેન ઠક્કર નામના 62 વર્ષના વૃદ્ધાએ પગમાં ની-રિપ્લેશમેન્ટનું ઓપરેશન કરાવ્યું હતું. આ ઓપરેશનના 4-5 દિવસ પછીથી વૃદ્ધાને પગમાંથી સતત લોહી નીકળી રહ્યું હોવાથી હોસ્પિટલમાં ડોકટરને જાણ કરી હતી. જે બાદ ડોક્ટરો અનેક વાર વૃદ્ધાની સર્જરી કરી અને પગમાં મોટું નુકસાન કરી નાખ્યું હોવાનો આક્ષેપ છે. વૃદ્ધાને હાલ પગ કાપવો પડે તેવી સ્થિતિ સર્જાઈ છે. ખોટા પગનું ઓપરેશન કર્યા બાદ પણ હોસ્પિટલે દર્દીની દીકરી પર બિલ ભરવા માટે દબાણ કર્યું તથા દીકરી સાથે છેડતી થઈ હોવાની ફરિયાદ પણ દાખલ કરવામાં આવી છે ત્યારે હોસ્પિટલની બેદરકારીના કારણે આજે પરિસ્થિતિ એવી સર્જાઇ છે કે જે દર્દી ચાલતા હોસ્પિટલમાં સારવાર લેવા આવ્યા હતા તેમને પથારીમાં બીજી હોસ્પિટલ લઈ જવા પડ્યા છે ગંભીર હાલતમાં.
સગાના દર્દીએ Vtv સાથે વાતચીત કરી હતી. Vtv સાથે વાતચીતમાં શૅલ્બી હોસ્પિટલ પર બંસરી ઠક્કરે આરોપ લગાવ્યો છે. તેમણે કહ્યું કે, સાહેબ, હું લોહાણાની દીકરી છું અને સત્ય-ન્યાય માટે ક્યારેય પાછી નહીં પડું, જ્યંતિ રવિ, સી.આર પાટીલ, નીતિન પટેલ, વિજય રૂપાણી સર અને PMO તમામને અરજી કરું છું તો ફરિયાદ દાખલ કરવાની સલાહ મળે છે. જ્યારે મહામંથનમાં એક દીકરી રડી પડી, કહ્યું મને ન્યાય અપાવો બસ... મારી માતાના ઉદરના લોહીમાંથી જન્મી તેના કરતા કદાચ વધારે લોહી મેં અત્યારે જોયું છે.

1). અમો અરજદાર ના માતૃ શ્રી ને ઘૂંટણ માં તકલીફ હોઈ અમો ચાલતા શેલ્બી હોસ્પિટલ માં બતાવવા ગયેલ. જ્યાં ડૉક્ટર વિક્રમ ભાઈ શાહ તેમજ તેમની ટીમ દ્વારા ઘૂંટણ નું ઓપેરશન કરવા તેમજ દાખલ થવા જણાવેલ.
2). અમો અરજદાર ની માતા નું ઘૂંટણ નાં ઓપેરશન માટે દાખલ 12.04.2021નાં રોજ થતાં ખર્ચ ની વિગત ની જાણકારી લીધેલ. અમોને ખર્ચ ની વિગત બાબતે ઓપેરશન ની સંપૂર્ણં સારવાર પૂર્ણ થાય ત્યાં સુધી ની રકમ અંદાજિત 2,78,000 રૂપિયા જણાવેલ.
3). અમો ડૉક્ટર ને ભગવાન સમજી ભરોસો રાખી દાખલ થયેલ. દાખલ થયેથી ઓપેરશન પણ કરવામાં આવેલ. અમો ખર્ચ ની રકમ નક્કી થયા મુજબ ભરપાઈ પણ કરેલ. અમોને વિશ્વાસ માં લીધા વગર ત્યાંથી 15.04.2021 નાં રોજ રજા પણ આપી દેવામાં આવેલ અને ડ્રેસિંગ બાબતે ની સમજ કરેલ.
4). અમો એ બીલ ભરપાઈ કર્યા બાદ ઘૂંટણ નું ઓપેરશન સારી રીતે થયેલ છે અને મારા માતા ફરીથી દુખાવા વગર ચાલતાં થઇ જશે તેમ અમોને જણાવેલ. અને અમો પરત ઘરે ગયેલ. અમોના માતા ને ઘરે લઇ ગયા બાદ ઘૂંટણ ના ઓપેરશન વાળી જગ્યાએથી ખુબ જ લોહી અને પરુ નીકળતું હતું. એનાથી બેડશીટ આખી ખરાબ થયાથી અને ડ્રેસિંગ વખતે અમોને માલુમ પડેલ કે ઓપેરશન બરાબર થયેલ નથી. તકલીફો વધુ ને વધુ ચાલુ છે. તેમ માલુમ પડેલ ત્યારે આમોએ શેલ્બી હોસ્પિટલ માં તરત સંપર્ક કરી પરત દાખલ 18.04.2021 નાં રોજ કરેલ.
5) પરત દાખલ કર્યા બાદ ડોક્ટરો દ્વારા સારવાર ચાલુ કરેલ. સારવાર દરમિયાન અમોની પાસે તરત રૂપિયા ની માંગણી કરેલ. અમોએ ઘૂંટણ ની સારવાર બાબતે નાં અગાઉ નક્કી થયાં મુજબ તમામ રૂપિયા HDFC ERGO વીમા કંપની દ્વારા ચૂકતે કરાવેલ. પણ મારાં માતા ને ઉત્તમ સારવાર મળી રહે અને મારાં માતા ને તકલીફો તેમજ દર્દ સહન ના કરવું પડે તે આશય થી પરત માંગ્યા મુજબ ની રકમ અંદાજિત 2,23,000 રૂપિયા તારીખ 18.04.2021 નાં રોજ અમોએ વીમા કંપની દ્વારા ચુકવણી કરાવેલ.
6). અમો અમોની માતા ની સારવાર દરમિયાન ડોક્ટરો દ્વારા ઓપેરશન દરમિયાન થયેલ ગંભીર ભૂલ ભરેલી બેદરકારી સુધારવાની જગ્યાએ નિત નવા અખતરાઓ કરેલ. જે તે સમયે ડૉક્ટર દ્વારા ઘૂંટણ ના ભાગ ની બાયોપ્સી લઇ રિપોર્ટ કરવામાં આવેલ. જે રિપોર્ટ તેઓ ની હોસ્પિટલ નાં ડૉક્ટર ની બેદરકારી બહાર ના આવે તેમજ દર્દી વધુ ને વધુ હેરાન કેમ થાય અને વધુ રૂપિયા કેમ પડાવવાં તેવાં બદ ઈરાદા થી શેલ્બી દ્વારા લેવામાં આવેલ બાયોપ્સી નો રિપોર્ટ શેલ્બી દ્વારા જ ચોકસાઈ પૂર્વક કરેલ ન હતો.
7). અમો ને માનસિક, શારીરિક તેમજ આર્થિક તમામ બાબતે અસહ્ય ત્રાસ આપવામાં આવેલ અને વધુ રૂપિયા ની માંગણી કરેલ.
8). અમોને અસહ્ય ત્રાસ આપતાં માતા ની પીડા જોવાની સહન શક્તિ ના રહેતાં અમોએ આનંદ નગર પોલીસ સ્ટેશન માં 10.5.2021 નાં રોજ ફરિયાદ કરેલ. તેમજ ગાંધી ચીંધ્યા માર્ગે આમરણ ઉપવાસ પર પણ ઉતરેલ જેની જાણ અમોએ લોક જાગૃતિ અને ન્યાય નાં હિત માં સોશ્યિલ મીડિયા પર અમો અમારો વિડિઓ બનાવી મુકેલ.
9). સોશ્યિલ મીડિયા નાં માધ્યમ થી અમોના સમાજ તેમજ ઇલેક્ટ્રોનિક અને પ્રિન્ટ મીડિયા અન્ય સમાજ તેમજ રાજકીય પાર્ટીઓ ન્યાય મળે તેવા આશય થી મદદે આવેલ.
10). અમોના માતૃશ્રી ની સારવાર દરમિયાન થયેલ ગંભીર ભૂલ ભરેલી બેદરકારી ઉજાગર થયેલ જેથી સેલ્બી નાં ડોક્ટરો મારા માતા ને મોત નાં મુખ માં ધકેલવાં નાં કામો કરેલાં. મારી માતા ની સારવાર ના થતી હોઈ તબિયત વધુ ને વધુ પડતી બગડતી હોઈ જેથી અમોએ ન્યાય માટે થઈને પોલીસે તેમજ અન્ય સક્ષમ સત્તા ના અધિકારીઓ પાસે મદદ ની માંગણી કરેલ જે તે સમયે અમોની પાસે વધુ રૂપિયા ની માંગણી પણ કરેલ. તેમજ તમામ પ્રકાર ની સારવાર અને સુવિધા (સર્વિસો) પણ બંધ કરવામાં આવેલ. અને મારા માતા ની ગંભીર હાલત હોવા છતાં પણ અમને વારંવાર હોસ્પિટલ માંથી જતા રહેવા દબાણ કરવામાં આવેલ. આ બાબત ની અનેક વાર 100 નંબર કંટ્રોલ મેસેજ, આનંદનગર પી આઈ , ઝોન 7 ડીસિપી સાહેબ તેમજ ઇન્ચાર્જ સેટેલાઈટ પીઆઇ શ્રી, તેમજ એસપી સાહેબ અને એસપી મેડમ સાહેબ ને પણ સમગ્ર પ્રકરણ બાબતે માહિતગાર હતાં. ન્યાય ની પ્રક્રિયા બાબતે કોઈપણ જાત ની નક્કર કાર્યવાહી કરેલ ન હતી.
11). શેલ્બી હોસ્પિટલ નાં ડોક્ટરો રાજકીય નેતા , સરકારી, અર્ધ સરકારી અધિકારીઓ તેમજ માથાભારે ઇસમો અને ઘરોબો સંબંધ ધરાવતાં હોઈ આ પ્રકરણ માં ભીનું સંકેલવાનાં તમામ પ્રયાસો થયા છે. જેના આધારે આજ દિન સુધી શેલ્બી હોસ્પિટલ નાં ડોક્ટરો ની ભૂલ ભરેલી બેદરકારી થી મારાં માતા મોત નાં મુખ માં ગયેલ તે બાબત ની ન તો ફરિયાદ તેમજ અન્ય સક્ષમ સત્તાધિકારીઓ દ્વારા કાર્યવાહી કરવામાં આવતી નથી.
12). અમો અરજદાર દ્વારા આનંદનગર પોલીસે સ્ટેશન માં જે તે ફરિયાદ સમયે શેલ્બી માં થયેલ સારવાર બાબત નાં પેપર્સ જમા કરાવેલ.

જેનાં આધારે સિવિલ હોસ્પિટલ નાં ડોક્ટરો પાસેથી શેલ્બી ની વગ નાં કારણે સિવિલ હોસ્પિટલ નાં ડોક્ટરો દ્વારા મેડિકલ નેગેલીજન્સી થતી નથી. જેથી આપની ફરિયાદ લેવામાં આવશે નહીં. સુપ્રીમ કોર્ટ નાં માનનીય જજ શ્રી લલિતા કુમારી ના જજમેન્ટનો આશરો લઇ હેલ્થ બાબતેની ફરિયાદ હોય તો સરકારી હોસ્પિટલ માંથી અભિપ્રાય લઈ ગુનો દાખલ કરવો. પરંતુ આપના કેસમાં સરકારી હોસ્પિટલનો ઓપિનિયન માં મેડિકલ નેગ્લિજેનસી સાબિત થતી નથી. જેથી આપની ફરીયાદ લેવામાં નહીં આવે તેમ જણાવેલ. શેલ્બી હોસ્પિટલ નાં ડોક્ટરો દ્વારા મળતિયાઓ સાથે મળી ભીનું સંકેલવાનું પુરતો પ્રયાસ થયો છે ને હાલમાં પણ થાય છે.
13). શેલ્બી હોસ્પિટલ નાં ડોક્ટરો દ્વારા મારાં માતા માધવીબેન નાં ઘૂંટણ ની બાયોપ્સી લેવામાં આવેલ હતી. તે બાયોપ્સી નો શેલ્બી દ્વારા રિપોર્ટ કરવામાં આવેલ જે અમોને શંકા જતા અમો દ્વારા અન્ય જગ્યાએ બાયોપ્સી નો રિપોર્ટ કરવા અમોએ પ્રયત્ન કરેલ.અને અમો રાજકોટ ભટ્ટ લેબોરેટરી નો સંપર્ક કરતાં આ રિપોર્ટ અમોને ત્યાં થશે તેમ જણાવેલ. જેથી અમો ભટ્ટ લેબ રાજકોટ ખાતે ગયેલ જ્યાં અમો બાયોપ્સી શેલ્બી દ્વારા લેવામાં આવી હતી તે આપેલ જેમાં શેલ્બી નો ટેગ હતો. જે તે સમયે અમોની પાસે રિપોર્ટ કરવાં નક્કી થયેલ. ચાર્જ રકમ ગૂગલ પેય માધ્યમ થી પેમેન્ટ કરેલ. જેની અમને રીસિપ્ટ મળેલ. અમોને જણાવેલ કે પાંચ દિવસ બાદ રિપોર્ટ તૈયાર થાય બાદ અમો આપને ટેલિફોનિક જાણ કરીશું. ત્યારે આપ રિપોર્ટ મેળવી લેશો. અમો રાજકોટ થી પરત ફરતાં સાંજે 04.00 થી 05.00 નાં સમય દરમિયાન અમોને ભટ્ટ લેબો. રાજકોટ થી ફોન આવેલ કે આપનો બાયોપ્સી રિપોર્ટ થઇ શકશે નહીં.આપ પરત લઈ જાઓ. અમો ત્યાંથી પરત ફરતા તે જ દીવસે ભટ્ટ લેબ પર ગયેલ.જ્યાં અમોએ રિપોર્ટ બાબતે ચૂકવેલરકમ તેમજ બાયોપ્સી નાં બ્લોકો અમોને પરત કરવામાં આવેલ રૂપિયા પરત ચૂકવ્યાં તેમજ બાયોપ્સી પરત આપ્યા નાં તેઓની પાસે રીસિવ કર્યા નાં કોઈપણ પુરાવા નથી. પરંતુ અમો પાસે તેનાં પુરાવા છે. આ બાબતે અમોએ પૂછેલ કે આપણે ત્યાં રિપોર્ટ થાય છે. આપે માંગ્યા મુજબ ની રકમ આપેલ છે તો શા માટે રિપોર્ટ નથી કરતાં ને પરત આપો છો? તો અમોને જણાવેલ કે શેલ્બી હોસ્પિટલ નાં ડોક્ટરો દ્વારા અમોના ડૉક્ટર સાહેબ ને ફોન આવેલ જેથી આપનો રિપોર્ટ નહીં કરી પરત આપવા જણાવેલ છે.
14). શેલ્બી હોસ્પિટલ નાં ડોક્ટરો દ્વારા તેઓ ની હોસ્પિટલ માં ઘૂંટણ ની સારવાર દરમિયાન લીધેલ બાયોપ્સી નો રિપોર્ટ સેલ્ફ રિક્વેસ્ટ થી અમદાવાદ ગ્રીન ક્રોસ લેબોરેટરી ખાતે કરાવામાં આવેલ. ત્યાંનાં રિપોર્ટ્સ તેમજ શેલ્બી નાં રિપોર્ટ માં ખુબ જ વિસંગતાઓ દેખાય છે. શેલ્બી હોસ્પિટલ દ્વારા ઘૂંટણ ની સારવાર દરમિયાન લેવામાં આવેલ બાયોપ્સી નો અમો દ્વારા રિપોર્ટ ડો અનિતા મેડમ બોર્જિસ

15). શેલ્બી નાં ડોક્ટરો દ્વારા દ્વારા ઘૂંટણ ની બાયોપ્સી લીધેલ હોઈ એ બાયોપ્સી નાં બ્લોકો માં પણ ગંભીર ભૂલ ભરેલી ખામીઓ હોઈ તે બાબત નો પણ અમોને ઇન્ટર સ્લાઈડ બદલી નાખેલ છે. જે અમોને લેખિત માં ફોટો કોપી પુરાવા સાથે ડો અનિતા મેડમ બોર્જિસ દ્વારા પણ જાણકારી આપેલ.
16). જે તે સમયે શેલ્બી હોસ્પિટલ નાં અસહ્ય ત્રાસ અને દબાણ ને કારણે તેમનાં રેકોર્ડ ઉપર 18.05.2021 નાં રોજ રજા આપેલ પરંતુ હકીકત માં અમોએ 23.05.2021 નાં રોજ અન્ય હોસ્પિટલ માં ત્યાંથી રજા લઇ દાખલ કરેલ. જેનાં પુરાવા શેલ્બી હોસ્પિટલ નાં CCTV કેમેરા, સ્થાનિક પોલીસ સ્ટેશન, મીડિયા તેમજ સમાજ ની હાજરી માં લઇ ગયેલ. ઇન્ડોવ્સક ની સારવાર દરમિયાન ઉસ્માનપુરા ઇમેજિંગ સેન્ટર દ્વારા પગ નાં ઘૂંટણ નાં ઓપરેશન વળી જગ્યા ઉપર એક્સ-રે કરાવેલ. જે રિપોર્ટ માં સિમેન્ટ સ્પેસર ઈલીગલીટી જણાવે છે.
17). અમો અરજદાર નાં માતા માધવીબેન ને ચાલતાં શેલ્બી હોસ્પિટલ લઇ ગયેલ પરંતુ અમોના માતાના સારવાર ના નામે અમો પાસે માત્ર રૂપિયા પડાવવામાં આવતા હતા. શેલ્બી હોસ્પિટલ નાં ડોક્ટરો દ્વારા મારા માતા ને મોત નાં મુખ માં ધકેલી દીધા હતાં. શરૂઆત નાં તબક્કે અમોને માલુમ નાં હોવાથી ડો. ને ભગવાન માની તેઓ દ્વારા જે કઈ પણ સારવાર કરતાં હતાં તેમાં અમો હાજી હાજી કરતાં રહ્યાં. જયારે અમોને સાચી હક્કીકત નું ભાન થયું કે મારાં માતા ને શેલ્બી હોસ્પિટલ નાં ડોક્ટરો તેમજ મેનેજમેન્ટ દ્વારા મોત નાં મુખ માં ધકેલી દીધેલ છે અને માત્ર રૂપિયા પડાવાનું કાર્ય થઇ રહ્યું છે. જેથી અમો મારા માતા ને મોત નાં મુખ માંથી બચાવી શકીએ અને ઉત્તમ સારવાર મળી રહે તેવાં આશય થી ઇન્ડોવ્સક હોસ્પિટલ, એસવીપી હોસ્પિટલ, જીસીઇએસ હોસ્પિટલ તેમજ કેરળ માં આવેલી અમૃતા હોસ્પિટલ માં સારવાર કરાવેલ. મારા માતા ચાલતા શેલ્બી હોસ્પિટલ ડોક્ટરો પાસે ગયેલ તો પણ એટલી હદ સુધી ગંભીર ભૂલ ભરેલી બેદરકારીઓ રાખી જુદાં જુદાં અખતરાઓ કરી મોત નાં મુખ માં ધકેલી દીધેલ જેનો અમો દ્વારા અથાગ સુધારવાનો પ્રયત્ન કરેલ છતાં પણ સફળતા ન મળી. અંતે શેલ્બી હોસ્પિટલ નાં ડોક્ટર દ્વારા મોત નાં મુખ માં ધકેલી દીધેલ તેમનાં દ્વારા કરવામાં આવેલ કાર્ય ને સફળતા મળેલ અને 23.07.2021 નાં રોજ મારાં માતા નું અવસાન થયું.
18). અમો દ્વારા અમારાં માતા નાં સારવાર માટે એસવીપી હોસ્પિટલ નાં ડોક્ટરો નો પણ સંપર્ક કરેલ. તેમનાં દ્વારા પણ લેખિત માં મળેલ પત્ર ની નકલ માં પણ સ્પષ્ટ જણાવેલ હતું.
મે માનનીય સાહેબ શ્રી,
સવિનય સાથે જણાવવાનું કે અમો ફરિયાદી નાં માતા સાથે શેલ્બી હોસ્પિટલ નાં ડોક્ટરો તેમજ મેનેજમેન્ટ દ્વારા ગંભીર ભૂલ ભરેલી બેદરકારી રાખી અમાનવીય કૃત્ય કરી મારાં માતા ને ચાલતા લઇ ગયેલ તે છતાં પણ મારાં હેસિયત કરતાં પણ વધુ રકમ નો ખર્ચ કરેલ. તો પણ મારાં માતા ને મોત નાં મુખ માં ધકેલી દેનાર ડોક્ટર ની ટીમો તથા મેનેજમેન્ટ પર અમોએ આપેલ પો. ફરિયાદ ન્યાય નાં હિત માં આજ દિન સુધી લીધેલ નથી. મારી જાણ મુજબ મેં લગભગ તમામ સક્ષમ સત્તા ઑથોરિટીઓ ની મારી સમજ મુજબ ઈમેલ તેમજ લેખિત માં ફરિયાદ કરેલ છે. પરંતુ આજ દીન સુધી અમોની શેલ્બી હોસ્પિટલ કે ડોક્ટરો નાં વિરુદ્ધ માં કોઈપણ જાત ની કાર્યાવહી કરવામાં આવેલ નથી. મારી જાણ મુજબ ભારત નાં બંધારણ માં કાયદાઓનું પોલીસ પ્રશાસન તેમજ અન્ય સક્ષમ સત્તાઓ દ્વારા કાયદા નું પાલન કરાવવાનું રહે છે. પરંતુ કાયદા નાં રક્ષક જ ભક્ષક બની ગયેલ હોઈ એવું લાગે છે. અમોએ અરજી માં જણાવેલ તે મુજબ રાજકીય ક્ષેત્ર, સરકારી, અર્ધ સરકારી ક્ષેત્ર, માથાભારે વ્યક્તિઓ સાથે સંકળાયેલ તેમજ વગ ધરાવતાં શેલ્બી હોસ્પિટલ નાં ડોક્ટરો તેમજ મેનેજમેન્ટ હોઈ જેથી અમોએ કરેલ ફરીયાદ પોલીસ લેતી નથી. તપાસ નાં નામે ટાઈમપાસ કરી રહ્યાં હોઈ તેમ પ્રથમ દ્રષ્ટિએ દેખાઈ આવે છે. પોલીસ પ્રશાસન નાં ઉચ્ચ અધિકારીઓ કાયદા નાં વિદ્વાન, જ્ઞાની તેમજ તજજ્ઞ હોવા છતાં પણ ઉચ્ચ હોદ્દા પાર બિરાજમાન અમોએ રજુ કરેલ તમામ પુરાવાઓ (અંગ્રેજી ભાષા માં) ડોક્ટર્સ નાં રિપોર્ટસો, શેલ્બી તેમજ અન્ય રિપોર્ટ્સ માં વિસંગતતા દેખાતી હોવા છતાં પણ શેલ્બી હોસ્પિટલ નાં ડોક્ટરો તેમજ મેનેજમેન્ટ ને બચાવવાનો લૂલો, પાંગળો પ્રયાસ કરી રહ્યાં છે. શેલ્બી નાં ડોક્ટરો, મેનેજમેન્ટ, પોલીસ પ્રશાસન તેમજ સિવિલ નાં મળતિયા ડોક્ટરો જે આ કેસ માં મદદગારી કરી રહ્યાં છે તેમને ફક્ત શેલ્બી નાં ઔપચારીક પેપર્સ ને ધ્યાને લઇ પૂર્ણ કેસ નો અભ્યાસ કર્યા સિવાય તેમજ અન્ય હોસ્પિટલ લેબો. નાં રિપોર્ટસો ને ધ્યાન માં લીધા વગર મેડિકલ નેગેલીજન્સી સાબિત થતી નથી. તેવું લેખિત માં આપી ભીનું સંકેલવાનાં સાથે રહી કાર્ય કરેલ છે. આપ સાહેબ શ્રી ને અમો અરજદાર ની નમ્ર વિનંતી સહ ન્યાય નાં હિત માં ઉચ્ચ હોદ્દા ઉપર સક્ષમ સત્તાધિકારીઓ સરકારી, અર્ધ સરકારી તમામ એજન્સીઓ આપ કાયદા નાં વિદ્વાન ને જ્ઞાની હોઈ અમોએ આ સાથે રજુ કરેલ પુરાવા ની ગંભીરતા થી નોંધ લઇ મારાં માતા તેમજ અન્ય પરિવારો સાથે શેલ્બી નાં ડોક્ટરો તેમજ મેનેજમેન્ટ દ્વારા કરેલ કૃત્ય બદલ ની ગંભીરતા થી નોંધ લઇ રજુ કરેલ પુરાવા ને ધ્યાને લઇ તાકીદે પો. ફરિયાદ દાખલ કરવામાં આવે તેમજ શેલ્બી હોસ્પિટલ મેનેજમેન્ટ વિરુદ્ધ માં કાયદાકીય તમામ પ્રકાર ની કાર્યવાહી કરવામાં આવે તે અમો અરજદાર ની નમ્ર લેખિત ફરિયાદ સહ વિનંતી છે.

Brief description as an Applicant: -
1). we went to Shalby Hospital for my mother’s check up as she was having knee pain. Over there, Do. Vikram Shah and his team advised us to go for admission and operation of knee.
2). For Knee operation Madhaviben Thakkar got admitted on 12.04.2021 and we understood expense details. Estimated cost for complete treatment will be given by hospital was rs. 2,78,000.
3). considering Doctor as a God we got admitted. Operation was performed on same day of admission. We have paid the amount as decided. We were given leave on 15.04.2021 with understanding of dressing without any explanation.
4). we have paid the bill as discussed and got updated that operation was done well and my mother would be able to walk again without any pain. We came back home after to this. So much of blood and puss was coming out from the area where knee operation was performed from the day we came back home. Bed sheet was so dirty and we came to know that operation was not done properly. Situation was getting worsen day by day. Due to this we contacted Shalby Hospital again and admitted back on 18.04.2021.
5). Upon re-admission doctors have continued treatment. During treatment, they immediately demanded rs. We have paid complete amount via HDFC ERGO as discussed earlier for Knee Replacement. But, with intention that my mother gets excellent treatment without pain once again we have paid additional amount of rs. 2,23,000 on 18.04.2021 via same insurance company.
6). During our mother’s treatment, instead of correcting the mistake; during operation, doctors did new experiments. At that time, biopsy was taken from knee for report. Report done by shalby was not done properly and with the intention of not revealing the negligence of doctor for the hospital to harassed patient and to snatch more amount of money.
7). we were tortured a lot mentally, physically and financially by demanding more money.
8). Due to unbearable torture given by shalby hospital to my mother and us; we have lodged a complaint at Anandnagar police station on 10.05.2021. Also, I set on fasting as per Gandhiji’s rule and have updated people with the help of social media by creating video for Public Awareness and justice.
9). Due to social media, many people came from society including electronic and print media as well political parties for help in getting justice.
10). As there is an alleged and serious mistake done by shalby hospital and doctors; they tried to kill my mother. My mother’s health was constantly getting deteriorated so, I have asked to get justice from police. Doctors also demanded more money from our end and they stopped all services and facilities. Despite her critical condition, we were repeatedly told us to leave the hospital. Many times I called on control number (100); Anandnagar PI, Zone 7 DCP Saheb as well as Satellite PI in charge, SP Saheb and SP Madam Saheb were known to this matter. No concrete action was taken in the matter of justice.
11). Doctors of shalby hospital are associated with political leaders, governments and semi-government officials so, no complaint has been lodged against medical negligence and for the death of my mother. Competent authority hides this and because of their relationship no action has been taken by them.
12). At the time of complaint we have submitted treatment papers of Shalby hospital at Anandnagar police station.

Because of strong relation of Shalby with civil hospital; Doctors have said that there is no medical negligence and because of that your complaint won’t be considered. They took the stand of Hon’ble Judge of Supreme Court, Shri Lalita Kumari and stated that complaint of healthcare can be filed after taking an opinion from govt. hospital only. And, in your case medical negligence is not proved. So, your complaint won’t be taken. Doctors of Shalby Hospital were tried and they are still trying to stop this matter.
13). Doctors of Shalby Hospitals have taken the biopsy of my mother Madhaviben Thakkar. Biopsy report which was done at shalby hospital due to unsatisfied result we have contacted bhatt laboratory in Rajkot. They updated that report will be done here so, we went to Rajkot with the biopsy given by shalby hospital with their tag. They have confirmed about report and updated it will be done within 5 days. We have paid amount via Google pay. Receipt of the payment we received and we were informed that we will get a call after five days once report is ready and you can then collect the report. On our way to home from Rajkot between 4.00 to 5.00 pm in the evening, we got a call to take biopsy back by stating it won’t be done here. We went to bhatt lab on same day from half of the route. We have got the refund amount and biopsy block which we have given to them. They have no proof that they have returned the biopsy block but we have the proof. We have requested and asked them that the amount which you said we have given then why are you denying for report? We were told that our doctor got a call from shalby hospital and said no to do this report.
14). Biopsy which was taken by Shalby Hospital during treatment upon self request we have done the same biopsy report of knee at Green Cross laboratory Ahmedabad. There were lot of discrepancies between reports. And, even we have requested,

We have requested them for report and it has lot of serious discrepancies between Shalby and other hospital reports.
15). Dr. Anita Madam Borges has mentioned in writing that biopsy taken by shalby doctors having many serious defects, and they interchanged biopsy blocks. They have shared photocopy of the same as evidence.
16). Due to unbearable torture and pressure she was discharged on 18.05.2021 from shalby hospital as per their record but in actual the date is 23.05.2021 and she was shifted to indovasc hospital. Evidence of same is available in the CCTV cameras of Shalby Hospital, at local police station, in media as well with the society. During indovasc hospital treatment, at usmanpura imaging center x-ray of operated knee have shown illegality of cement spacer.
17). we as an applicant took our mother madhavi ben to shalby hospital by walking on her on foot. But, on the name of treatment only money has been taken from our end. Doctors of Shalby Hospital have pushed my mother’s life in the brink of death. At the initiation we were not aware so, considering doctor we accept all the treatment given by them and agreed to them. When we actually understand and realize that they have pushed my mother’s life in the brink of death and they are just interested in gathering money. So, to save my mother’s life and for her better treatment we have taken the service in various hospitals as an indovasc hospital, S. V. P. Hospital, G.C.S. Hospital and Amrita Hospital of Kerala. We have tried lot to change and save my mother’s life; but shalby has ruined in a way with worst experiment that we couldn’t got success and at last because of their serious and fraudulent mistake of shalby hospital we lost our mother. At last shalby hospital’s doctors and their team pushed my mother’s life in the brink of death and they got success and we lost our mother on 23rd July, 2021.
18). We have contacted doctors of SVP Hospital for the treatment of my mother. In writing they clearly stated about her situation.

We have spent money more than our level, capability and strength to save my mother whom we took hospital on her own foot for betterment of life, but doctors of shalby hospital including management have done serious, fraudulent and worst act of negligence and inhuman act. Doctors of shalby hospital and management pushed my mother’s life to the brink of death. None of the complaint has been taken up to the interest of justice till date.
We have complained almost all competent authority via writing over an email but till date no action has been taken against shalby hospital and doctors. According to the constitution of India and as per law enforced police administration and competent authority has to take care of law and justice but it seems that they are trying to save wrong stuff by not supporting right course of action.
Shalby Hospital and management as well doctors of shalby hospital are associated with political parties, government, semi-government sector and strong people that’s why police is not taking complaint by supporting them.
It’s clearly visible that police and authorities wasting time by not understanding human values and not doing proper mean of investigation. Despite all evidence presented by us in English IPS level officers who pretend to be knowledgeable and expert they are not performing the action against human life and medical negligence. We have already shared reports of shalby hospital and other places where clearly discrepancies were visible. Ideally police and civil hospital’s doctors have to review case from the inception covering all sides but they have share the status with one sided reviewance of case. Anyhow they are trying to hide medical negligence and saving shalby hospital and team of doctors like Vikram Shah.
It’s our humble request being applicant that consider all reports with seriousness by understanding the value of human and humanity as a factual part. Bring justice on the table considering competent authorities, govt and semi government sector for this incident as a part of resultant honesty and valuable support for my mother as well for other families.
Seeking support to take justice out by taking legal action on such doctors, shalby management and staff upon the evidence presented. I pray you to advise higher authority and competent parties to lodge a complaint by taking legal action against management of shalby hospital and Doc. Vikram Shah.
